Terms and Conditions for Surgical Scissor Sharpening Services

These Terms and Conditions (“Agreement”) govern the use of scissor sharpening services (“Services”) provided by Planatome (“we,” “us,” “our”) for surgical scissors and similar instruments (“Products”) sent from private medical practices (“Customer,” “you,” or “your”). By submitting your scissors to us for sharpening, you agree to comply with these Terms and Conditions. Please read them carefully.
1. Services Provided
1.1 Scissor Sharpening: Planatome offers professional sharpening services for surgical scissors, medical instruments, and related products. Our sharpening process is designed to restore the cutting edge of your scissors to a state that meets the necessary standards for medical use.
1.2 Inspection and Evaluation: Upon receipt of the scissors, Planatome will conduct a thorough inspection to evaluate the condition of the blades. This includes checking for any defects, damage, or wear beyond what can be repaired by sharpening.
1.3 Turnaround Time: Planatome will strive to complete sharpening within 5 business days of receipt. Expedited services are available upon request for an additional fee. If there are any delays or issues with the turnaround time, we will notify you promptly.
2. Customer Responsibilities
2.1 Shipping and Delivery: Customers are responsible for securely shipping scissors to Planatome for sharpening. We recommend using a tracked shipping method to ensure the safe delivery of your items. All Shipping costs (including returns) are the responsibility of the Customer, unless otherwise agreed upon.
2.2 Inspection Before Submission: Customers must inspect the scissors before submitting them for sharpening. The Customer is responsible for ensuring that the scissors are free of contaminants (such as blood, bodily fluids, or biological materials) before shipping them to Planatome. If contamination is found, we may return the scissors without performing services, and the Customer will be responsible for any return shipping fees.
2.3 Providing Accurate Information: The Customer agrees to provide accurate contact information, including the shipping address, billing address, and any relevant details regarding the scissors. Planatome is not responsible for any delays or issues caused by incorrect information.
3. Pricing and Payment
3.1 Pricing: The price for sharpening services will be determined based on the condition of the scissors and the scope of work required. Prices are provided on request or as posted on our website or other official communication.
3.2 Payment Terms: Credit Card or Net 30. Full payment for sharpening services is due within 30 days of completion of the work.
3.3 Late Payment: If payment is not received within 30 days from the invoice date, a late fee of 1.5% of the outstanding balance will be applied per month, or the maximum amount permitted by law.
4. Warranty and Quality Assurance
4.1 Service Guarantee: Planatome provides a satisfaction guarantee for our sharpening services. If you are not satisfied with the results, we will re-sharpen your scissors at no additional cost, provided the complaint is made within 15 days of receipt.
4.2 Limitations of Warranty: Our warranty does not cover scissors that are irreparably damaged, misused, or altered outside the scope of our services. If the scissors are found to be beyond a serviceable state (e.g., excessive rust, broken parts, or severe physical damage), we will inform the Customer and provide an estimate for replacement or alternative services.
5. Liability
5.1 Limitation of Liability: Planatome is not liable for any indirect, incidental, special, or consequential damage arising from the use or handling of your surgical scissors, including, but not limited to, injury, loss of use, or damage to the product.
5.2 Loss or Damage to Property: While we take all reasonable precautions to safeguard your scissors during the sharpening process, we are not liable for any damage, loss, or theft that occurs during the shipping process or while in our possession. It is the Customer’s responsibility to insure valuable items if necessary.
5.3 Health and Safety: Planatome makes no warranties regarding the use of the sharpened scissors, including their safety or suitability for medical procedures. It is the Customer’s responsibility to ensure that the scissors are used in accordance with applicable health and safety standards.
6. Confidentiality and Privacy
6.1 Privacy of Customer Information: Planatome is committed to protecting the privacy of your personal and business information. All customer data is handled in accordance with our Privacy Policy, available on our website.
6.2 Confidentiality of Materials: Any proprietary materials, medical data, or business information shared with Planatome in the course of providing services will be kept confidential and will not be disclosed to third parties without your prior consent, unless required by law.
7. Returns and Cancellations
7.1 Cancellation Policy: If you wish to cancel your order before the sharpening work has begun, please notify Planatome within 24 hours of submitting your order. Once the sharpening or repair process has begun, cancellations may not be possible, and the full-service fee will be charged.
7.2 Return of Scissors: After services are completed, all scissors will be returned to the Customer at the shipping address provided. If the Customer wishes to return scissors due to dissatisfaction or for any other reason, we ask that you contact us within 15 days after receipt. Returns are only accepted for scissors that have not been used after being returned.
8. Indemnification
You agree to indemnify, defend, and hold harmless Planatome, its officers, directors, employees, agents, and affiliates from any claims, losses, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the services, including any violation of these Terms and Conditions.
9. Governing Law and Dispute Resolution
9.1 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state of Arizona, without regard to its conflict of law principles.
9.2 Dispute Resolution: Any disputes arising from this Agreement or the services provided will be resolved through arbitration, conducted in Maricopa County, State of Arizona. If arbitration is chosen, it will follow the rules of Compulsory Arbitration.
10. Modifications to These Terms
Planatome reserves the right to modify or update these Terms and Conditions at any time. All changes will be posted on our website, and the updated Terms will take effect immediately upon posting. It is the Customer’s responsibility to review these Terms regularly for any changes.
